UK trade mark registration
There are two ways an Australian trade mark owner can seek trade mark protection in the UK:
- File an application directly in the UK through a UK trade mark agent; or
- File an application through the Madrid Protocol (WIPO). This is an international registration system which allows trade mark owners the option of protecting their trade mark in multiple countries by filing one application.
If you file an application through the Madrid Protocol, and you wish to nominate other European countries, you can file a European Union application which will include the UK.
If the UK is the only European country you wish to file in, you can nominate UK only instead of having coverage in all of the 28 member countries of the European Union.
